Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The prosecution case as per F.I.R is that the truck of the informant was robbed by unknown

Patna High Court CR. MISC. No.1656 of 2021(7) dt.15-02-2022 2/3 miscreants. The accused persons also assaulted the informant and Khalasi and taken away watch, mobile and cash of the informant.

It is submitted by learned counsel for the petitioner that F.I.R was registered against unknown. The name of the petitioner transpired on the confessional statement of co-accused Anil Ram. Moreover, nothing has been recovered from the conscious possession of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the aforestated facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 1st, Barh in connection with Lakhisarai P.S. Case
