JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This is an application for grant of anticipatory bail in connection with Janki Nagar P.S. Case No. 51 of 2016, disclosing offences under Sections 147, 148, 341, 342, 323, 324, 325, 504, 506, 379, 307, 34 of the Indian Penal Code. Allegation against the petitioner and other accused persons is that they chased the son of the informant and dragged him from his tractor and one co-accused Butal Yadav ridden the tractor over the son of the informant causing severe injury. Submission of learned counsel for the petitioner is that there is no allegation of assault against the petitioner and he has falsely been implicated in this case and main allegation is against one co-accused Bhutal Yadav, who was driving the said tractor.

Heard learned A.P.P. also, who opposed the prayer for

Patna High Court CR. MISC. No.74882 of 2018(3) dt.11-04-2019 2/2 anticipatory bail of the petitioner stating that the hand of the petitioner is also there and the whole act is brutal. Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail.

Accordingly, this application is dismissed.
