JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 This is an application for grant of anticipatory bail in connection with Bandeya P.S. Case No. 05 of 2019, disclosing offences under Sections 448, 341, 342, 324, 323, 325, 307, 379, 504, 506, 34 of the Indian Penal Code.
As per prosecution case while the informant sitting near the house, petitioner along with other accused persons came and assaulted him, causing injury. There is specific allegation of assault against the petitioners to the informant and others.
Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties and the injuries were found to be simple in nature, which will appear
Patna High Court CR. MISC. No.44285 of 2019(2) dt.18-07-2019 2/2 from the Annexure 3C. Except one injury which has been attributed to Santosh Yadav, who is not the petitioner in this case.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad, in connection with Complaint Bandeya P.S. Case No. 05 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
