2. The petitioner apprehends his arrest in connection with Silao P.S. Case No. 104 of 2023 registered for the offence punishable under Sections 341, 323, 307, 504, 506 / 34 of the Indian Penal Code.
3. As per the prosecution case, when the informant reached at his land for ploughing, the petitioner alongwith his son and wife assaulted the informant causing head injury.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The informant is own brother of the petitioner and there is land dispute between the parties. There is case and counter case between the parties and the injury is simple in nature caused by
Patna High Court CR. MISC. No.49674 of 2023(2) dt.11-08-2023 2/2 hard blunt substance. The petitioner has one criminal antecedent under the Electricity Act, in which he is on bail.
5. Learned A.P.P. opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of his arrest or surrender before the Court below within six weeks from today, the above named petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S. Case No. 104 of 2023 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
