2. The petitioner seeks bail in Sherghati Excise P.S. Case No. 90 of 2024 registered under Sections-30(a) & 32(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. The prosecution case, in short, is that on the tip off, the informant along with other police personnel reached at the place of occurrence where the petitioner was arrested at the spot and on search, 70 litres of illicit liquor was recovered from petitioner's motorcycle.

4. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.52144 of 2024(2) dt.31-07-2024 2/2 petitioner. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner had no knowledge regarding the alleged incident. The petitioner is in custody since 05-06-2024.

5. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, specially the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Suresh Kumar Singh-II, learned Exclusive Excise Court No.-3, Gaya in connection with Sherghati Excise P.S. Case No. 90 of 2024 with condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
