2. The petitioners apprehend their arrest in connection with Karpi P.S. Case No. 161 of 2017 registered for the offences punishable under sections 147, 149, 323, 341 & 307 of the Indian Penal Code.
3. Learned senior counsel appearing for the petitioners submits that though the petitioners are named in the FIR, there is no serious or specific allegation against any of them and the main allegation is against co-accused Diwali Bind, who has been chargesheeted. After the investigation, the petitioners were not sent up by the police though the learned Magistrate summoned them while differing with the police conclusion
Patna High Court CR. MISC. No.49290 of 2026(2) dt.29-07-2026 2/2 without mentioning sufficient reasons, in a mechanical manner. It is lastly submitted that among the petitioners, petitioner Nos. 3 and 4 bear no criminal antecedent, though the rest of the petitioners have criminal antecedents of some cases but they are on bail in those cases.
4. Learned APP for the State opposes the prayer of the petitioners.
5. Considering the above submissions and mainly taking into account the nature of the allegation appearing against the petitioners, coupled with the completion of the investigation against them and the genesis of the occurrence, this Court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Karpi P.S. Case No. 161 of 2017, subject to the conditions as laid down under Section 482(2) of the BNSS.
