2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 409, 420 and 34 of the Indian Penal Code.
3 . It is alleged that this petitioner in connivance with the then Panchayat Secretary, then Gram Panchayat Mukhiya Ward member and Ward Secretary has defalcated Government money of Rs. 4,25,000/- of "Nal Jal Yojana" .
4. By filing a supplementary affidavit on behalf of the petitioner it is stated that petitioner is ready to return the alleged
Patna High Court CR. MISC. No.57615 of 2023(4) dt.25-09-2023 2/3 amount of Rs. 4,25,000/- as per scheduled in the paragraph-2 of the supplementary affidavit.
5 . Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J . M. 1st , Sheikhpura in connection with Korma P.S. case No. 51 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure , in the light of following conditions:
A. Petitioner is directed to deposit Rs. 1,25,000/- ( Rupees One lakh twenty five thousand ) at the time furnishing bail-bond through Bank Draft in the Court below. B. Rest amount of Rs. 3,00,000 ( Rupees Three Lakh) be paid in 3 equal installments i. e . at the rate of Rs. 1,00,000/- ( One lakh) per installment within a period of three months from the date of furnishing bail-bond. C. If petitioner fails to comply with the aforesaid direction of this Court, the court below is free to cancel the bailbond of the petitioner. 5 . It is made clear that without going into merit of the
