The petitioners, who are the parents-in-law of the deceased, seek bail in anticipation of their arrest in connection with Mohammadpur P. S. Case No. 71 of 2020, instituted for the offences under Sections 304 B and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that because of their relationships with the husband of the deceased, they have been made accused in this case.

Patna High Court CR. MISC. No.2729 of 2021(2) dt.20-07-2021 2/3 It has also been submitted that the factum of death of the deceased was informed to her parents and family members but for some reason or the other, perhaps under a wrong advice, this case has been lodged.

There is no specific accusation against the petitioners.

The deceased, according to the learned counsel for the petitioners, had been suffering from mental debility for which she was being treated regularly by a Neurologist at Chapra.

The dead-body of the deceased was actually found in the bed room which was locked from inside. Considering the afore-stated facts and specially taking into account that the husband of the deceased is in custody, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of

No.2729 of 2021(2) dt.20-07-2021 3/3 this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - I, Gopalganj, in connection with Mohammadpur P. S. Case No. 71 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
