The petitioner is apprehending her arrest in connection with Hathauri P.S. Case No. 87 of 2016 registered for the offences punishable under Sections 341, 420, 467, 468, 471 and 120B of the Indian Penal Code.
Allegation against the petitioner is of cheating various persons on the assurance of providing job in the Railways and a sum of total Rs.68,00,000/- has been taken from them. It has been submitted on behalf of the petitioner that as a matter of fact a case with respect to kidnapping of the petitioner has been lodged and for that petitioner has falsely been implicated in a false and concocted case and not a single witness among so-called cheated persons has been examined.
Patna High Court Cr.Misc. No.36713 of 2017 (2) dt.18-08-2017 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail stating that petitioner has cheated large number of persons on the assurance of providing job in the Railways.
Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
Let petitioner surrender before the court below and pray for regular bail, which shall be considered on its own merit. With the above observation, this application is dismissed.
