JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Alauli P.S. Case No. 280 of 2018, registered under Sections 341, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Chief Judicial Magistrate, Khagaria.

The accusation is that while petitioner opened fire at the informant, Md. Zulfiqar, but the same was hit to covillager, Md. Nikail. Learned counsel for the petitioner submits that, in fact, informant of the present case opened fire, which hit to Md. Nikail, regarding which, wife of the petitioner lodged Khagaria

Patna High Court CR. MISC. No.72684 of 2018(4) dt.17-04-2019 2/2 (Chitragupta Nagar) P.S. Case No. 329 of 2018. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
