The petitioner apprehends his arrest in connection with Complaint Case No.2492 of 2015/T.R. No.3847 of 2016 registered under Sections 323, 379 and 498(A) of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act. The accusation is of torturing the complainant/opposite party no.2 by her husband (petitioner) and other in-laws for non fulfillment of the dowry demand and also to remove her from the
Patna High Court Cr.Misc. No.9109 of 2017 (6) dt.20-09-2017 2/3 matrimonial house by snatching her personal belongings. Learned counsel appearing on behalf of the petitioner submits that on the joint prayer, earlier, the matter was referred to the Patna High Court Mediation Centre, Patna, for settlement of the dispute in between the petitioner and the opposite party no.2, who are husband wife respectively but the mediation could not succeed. While the petitioner was ready to keep his wife (the complainant/opposite party no.2) with full honour and dignity but the complainant/opposite party no.2 wants to one time settlement. Learned counsel appearing on behalf of the complainant/opposite party no.2 submits that the complainant/opposite party no.2 has filed an application under Section 125 of the Code of Criminal Procedure against the petitioner for maintenance in the court of the Principal Judge, Family Court, Samastipur.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Samastipur, in connection with Complaint Case No.2492 of 2015/T.R. No.3847 of 2016, subject
