JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of writ in the nature of mandamus directing the Respondents authorities particularly the Respondent Circle Officer to remove the encroachment made by Respondent No.7 over the path way / lane, which abuts Plot No.3947 of Khata No.477 under Thana No.66 from western side, by raising permanent construction of boundary wall and "Chhaja" (overhang at the lower edge of wall) at the height of 4 feet causing much in convenience to the passersby.

For further direction upon the Respondent No.5 to initiate land encroachment proceeding and remove the encroachment made by private Respondent No.7, who has created obstruction in smooth movement of the villagers, which was common way utilized by the villagers to approach the main road."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondent No. 5 i.e. the Circle Officer, Ratni Faridpur, District-Jehanabad, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
