JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-11-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Danapur Police Station Case No. 123 of 2017, disclosing offences under Sections 399, 402, 413 and 414 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing incriminating has been recovered from the possession of the petitioner rather the alleged recovery has been made from the shop of one Chand Miyan, who happens to be the son of the petitioner. No cogent material has come during course of investigation against this

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Danapur Police Station Case No. 123 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
