2. Petitioner is in custody in a case registered for the offence under Sections 317(4), 317(5), 318(4), 336(3), 338, 3(5) 112 and of the B.N.S.
3. As per the allegation in the FIR, one motorcycle bearing Registration No. BR-26L-0217 was recovered from the possession of the present petitioner, which was being used by having a false Registration No.JH-10AU-4883.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner has neither stolen the alleged motorcycle and nor changed the Registration number.

No.46607 of 2025(2) dt.31-07-2025 2/2 He next submits that he had only purchased the seized motorcycle from one person, namely, Raushan Kumar, who also told the petitioner that he will provide the documents regarding motorcycle after some time. He next submits that the petitioner had no knowledge that he had purchased a stolen motorcycle. He next submits that petitioner is in custody since 25.04.2025 and has got no criminal antecedent as stated in para-3 of the bail petition.
5. Learned APP for the State opposes the prayer for Regular bail of the petitioner.
6. Considering all facts and circumstances of the case and submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sherghati, Gaya in connection with Amas P.S. Case No.117 of 2025 with a condition that petitioner shall remain physically present on each and every date fixed by the learned Trial Court.
