1. Heard learned counsel for the parties.
2. The petitioner in this application prays for bail apprehending his arrest in connection with Ghorasahan P.S. Case no.456 of 2023 registered for the offence punishable under sections 413, 414 and 34 of the Indian Penal Code.
3. As per the prosecution case, it is stated that while accused Karan Kumar was arrested along with the motorcycle of which he did not produce any documents, one of the accused escaped. On enquiry, Karan Kumar stated that it was the petitioner who had escaped.
4. Learned counsel for the petitioner submits that neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The only material against him is the statement of a co-accused made before police. The petitioner has no criminal antecedent and co-

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner not having been arrested at the spot, grant of bail to Karan Kumar on whose confessional statement made before police, the name of the petitioner transpired and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Ghorasahan P.S. Case no.456 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikarhna at Dhaka, East Champaran, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
