The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354B and 504/34 of the Indian Penal Code. As per prosecution case, when the informant and her husband was storing hay, several accused persons including the petitioners came there armed with lathi, farsa and spade and started to assault them due to which the informant sustained injury.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

No.57849 of 2021(2) dt.25-04-2022 2/2 further submits that there is case and counter case between the parties and general and omnibus allegation against them and similarly situated co-accused persons have already been granted anticipatory bail by this Court passed in Cr. Misc. No. 55351 of 2021. Petitioners have got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Madhuban P.S. Case No. 135 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
