JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Sirdalla (Meskaur) P.S. Case No. 254 of 2018 dated 20.08.2018 instituted for the offences under Sections 147, 149, 325, 323, 456, 427, 379, 504 of the Indian Penal Code.

The petitioners, who are five in number are alleged to have entered the house of the informant, ransacked the same and also tore certain documents which was in the nature of manuscripts. The informant claims to have been injured in the occurrence.

The learned counsel for the petitioners has submitted that the allegations against the petitioners are general and omnibus in nature. The case was lodged after

Patna High Court Cr.Misc. No.73315 of 2018(3) dt.15-01-2019 2/2 two days of the occurrence without there being any explanation for the same. The petitioners are co-villagers of the informant and for some petty dispute, the occurrence is said to have taken place. Though the informant has received injuries on his person but the present case has not been lodged under Sections 307 or 308 of the Indian Penal Code. Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Nawada in connection with Sirdalla (Meskaur) P.S. Case No. 254 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
