The petitioners seek bail in connection with Nawanagar P.S. Case No. 118 of 2021 instituted for the offences under Sections 461 and 379 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are in custody since 02.06.2021, charge-sheet has been submitted in the case and are having antecedent of five cases. Learned counsel for the petitioners submits that the informant alleges that on 27.03.2021 he along with his staff Ajay came to his showroom and found lock of showroom, cash counter and locker broken and thus alleges, based on C.C.T.V. footage, that the occurrence was committed by two persons early in the
Patna High Court CR. MISC. No.57634 of 2021(2) dt.02-03-2022 2/2 morning and two mobile along with Rs. 2,70,000/- was also stolen. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case, the image found in the C.C.T.V. does not resemble with the petitioners and merely on the basis of suspicion, they have been arrested. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners and submits that the petitioners have got antecedent of five cases and if bail is granted to the petitioners at this stage, then the petitioners will abscond.
Considering the fact that the petitioners are in custody, charge-sheet has been submitted in the case and as submitted by the learned counsel for the petitioner that their name came in the confessional statement of co-accused, let the petitioners above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 118 of 2021 with a condition that one of the bailor shall be the relative of the petitioner and the petitioner shall be released only after framing of charge.
