The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 420, 467, 409, 468, 471 and 120(B) of the Indian Penal Code.
An FIR has been lodged on the direction of this passed in Public Interest Litigation vide C.W.J.C. No. 15459 of 2014 and vigilance enquiry was started. It was found that certain persons have entered into service of teacher on false and fabricated document. Petitioner has not resigned but departmental proceeding is going on for submitting false and fabricated document. Petitioner is a lady.
Looking to the facts and circumstances of the case, in the
Patna High Court Cr.Misc. No.40751 of 2017 (2) dt.22-09-2017 event of arrest or surrender within four weeks from today, let petitioners, namely, Radha Kumari, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No.662 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that petitioner will cooperate during investigation and join for interrogation, in failure the police will be at liberty to file an application for cancellation of bail.
