JUSTICE RAJIV ROY ORAL ORDER 14-07-2025 Learned counsel for the petitioners prays for and is allowed to implead the District Land Acquisition Officer, Aurangabad as respondent no.6 in course of the day.
2. Heard Mr. Yugal Kishore, learned counsel for the petitioners and learned counsel representing the State.
3. The present petition has been preferred for the grant of following relief(s):
"for issuance of a writ in the nature of
Patna High Court CWJC No.10937 of 2025(2) dt.14-07-2025 2/3 Mandamus commanding and directing the respondents to pay compensation for the land bearing khata no.- 162, khesra no.- 1107, area 0.135 Acre of land situated Panchayat Barnsarampur, Block/Anchal/P.S.-Dhibra, District-Aurangabad, Bihar, which has been acquired by the respondents for construction of 4/6 lane road under Bharatmala Pariyojana from Varanasi to Kolkata and even after completing the project the respondents have not paid a single rupees to the petitioners on the ground that they have not produced document of the land in question and also for issuance of a writ in the nature of Mandamus commanding and directing the respondents to pay compensation as per land acquisition Act along with interest on the award amount as per current rate of interest of Bank and also to direct the respondents to reverify the document of the land in question from the petitioners and then to pay compensation without any further delay and/or pass any order orders as may deems fit and

4. At the outset, learned State counsel has pointed out to the order passed by the Circle Officer, Deo as contained in Annexure P/1 dated 23.10.2024.
5. Mr. Yugal Kishore, learned counsel for the petitioners submit that now they are armed with the document to support their case and they shall be approaching newly added respondent the District Land Acquisition Officer, Aurangabad in next four weeks.
6. If the petitioner approaches in the aforesaid period, the the District Land Acquisition Officer, Aurangabad after putting the parties on notice and hearing them, shall be taking a decision preferably by 31st of December, 2025.
7. The writ petition stands disposed of.
