JUSTICE RAJIV ROY ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and the learned APP for the State through virtual mode in view of COVID-19. The petitioner apprehends his arrest in connection with Bikramganj P.S. Cae No.236 of 2021 instituted under Sections 147,148,149,307,379,427 of the Indian Penal Code and 27 of the Arms Act.

As per the prosecution story, the informant alleged that the accused persons who were variously armed, entered his house and took away Rs.1,32,000/-. While retreating, they also smashed his Safari car and the motorcycle. Further allegation is of opening fire in which the son of the informant narrowly survived. Learned counsel for the petitioner submits that only due to village rivalry, host of persons have been made accuseds, the petitioner being one of them. Further, he do not have any role to play in it and there is omnibus allegation against him. Learned APP on the other hand opposes the prayer for

Patna High Court CR. MISC. No.48105 of 2022(2) dt.06-01-2023 2/2 anticipatory bail stating that allegation is of decamping with the amount and smashing the vehicles of the informant's side. Taking into account the fact that the petitioner is a young boy of 19 years, he do not have criminal antecedent and as per the submissions put forward by the learned counsel for the petitioner, he is a student, there is an omnibus allegation against him, this Court is inclined to grant him relief.

Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Bikramganj P.S. Cae No.236 of 2021 to the satisfaction of learned Additional Chief Judicial Magistrate, Ist, Bikramganj, subject to the conditions as laid down under Section 438(2) of the Cr.P.C to the condition that he will be visiting the concerned police station for six months every fortnight to mark his attendance.
