The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402, 411, 120(B)/34 of the Indian Penal Code & Sections 25(1-b)a, 26, 35 of the Arms Act. The prosecution case as per F.I.R is that coaccused and petitioner, variously armed, have assembled and are planning for commission of dacoity. On seeing the police party they tried to flee away and on chase two persons were apprehended who disclosed their name as Md. Mushtak @ Md. Anwar Mustak and Santosh Kumar.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that neither the petitioner is apprehended on spot nor anything incriminating has been recovered from his conscious possession. There is no material direct or indirect against the petitioner on the basis of alleged disclosure made by the apprehended person. in the background of some land dispute, the present F.I.R has been registered. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the
