JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-09-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Brahmpur P.S. Case No.129 of 2017 registered under Sections 447, 448, 342, 323, 504, 506 and 325 of the Indian Penal Code as well as under Sections 4 and 5 of the Prevention of Witch Practices Act, 1999.
It is submitted by the learned counsel for the petitioners that save and except the offence punishable under Sections 4 and 5 of the Prevention of Witch Practices Act, all the offences alleged
Patna High Court Cr.Misc. No.41725 of 2017 (2) dt.20-09-2017 2/2 against the petitioners are bailable in nature. The informant has lodged the instant case in retaliation to Brahmpur P.S. Case No.128 of 2017 filed by the son of petitioner no.1 against the family members of the informant.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.
Considering the facts and circumstances of the case, the petitioners, namely, Mohan Ram @ Bhorik Ram, Amarjeet Ram, Raju Munna Ram @ Raj Munna Ram, Munna Ram and Asharfi Devi are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No.129 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
