2. The petitioner is apprehending his arrest in connection with Akbarpur P.S. Case No. 25/2023 dated 14.01.2023, registered for the offences punishable under Sections 8(b) and 20(a)(b) of N.D.P.S. Act pending in the Court of learned District and Sessions Judge-Cum-Special Judge, NDPS Act, Nawada.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.48735 of 2023(3) dt.12-09-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that no any incriminating article has been recovered from the house or from the conscious possession of the petitioner.
