====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 16-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Akbarpur P.S. Case No. 233 of 2025, registered for the offences punishable under Sections 317(4) and 315(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per prosecution case, there is recovery of one stolen motorcycle from the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 10.05.2025.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail
Patna High Court CR. MISC. No.46584 of 2025(3) dt.16-09-2025 2/2 on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada/concerned Court below in connection with Akbarpur P.S. Case No. 233 of 2025 with the following conditions:- (i) Both the bailors will be close blood relatives of the petitioner.
(ii) the petitioner shall mark his attendance at Rajouli Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
(iii) Before accepting the bail-bond of the petitioner, the Court below shall verify how many criminal cases are pending against the petitioner. It has been stated that he is accused only in one other case, namely Akbarpur P.S. Case No. 475 of 2020. If it is found that he is involved as an accused in any other case(s), his bail-bond shall not be accepted.
8. This application for regular bail shall stands allowed.
