JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-09-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 89 of 2015 for the offences punishable under sections 147, 148, 149, 323, 302, 325, 307, 506, 509 and 120 (B) of the I.P.C. The learned counsel for the petitioner submits that in this case four accused persons have faced trial vide Sessions Trial No. 328 of 2015 and they have been acquitted as the informant has not supported the allegation. The specific allegation for giving fetal blow is against Dhrup Kumar and Ravi Kumar Gupta and they have been faced trial and have been acquitted. Against the

Patna High Court Cr.Misc. No.44221 of 2017 (2) dt.21-09-2017 2/2 petitioner there is no specific allegation and as such he deserves sympathetic consideration. Copy of the judgment of Sessions Trial No. 328 of 2015 has been filed which is taken on the record. The learned A.P.P. fairly submits that four accused persons including Ravi Kumar Gupta and Dhrup Kumar have already been acquitted.

In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Bettiah, District- West Champaran in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
