The petitioner apprehends his arrest in connection with Maner P.S. Case No.461 of 2021 (Special Case No.4140 of 2021), registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

20 litres of Mahua wine has been recovered from the house of the petitioner.

Learned counsel for the petitioner has filed a supplementary affidavit stating therein that the said house is a joint family property. It is submitted that petitioner is innocent and has falsely been implicated in the present case. It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application.

Patna High Court CR. MISC. No.57269 of 2021(6) dt.13-10-2022 2/2 Taking into consideration the facts and circumstance of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
