21-06-2021 Heard learned counsel for the parties through video conferencing.
The petitioners seek bail in G.R. Case No. 1188 of 2020, arising out of Piro P.S. Case No. 74 of 2020, registered for the offence under Section 392 of the Indian Penal Code. As per the prosecution case, on 16.03.2020 at about 5:30 PM, while the informant was returning to his house on his bike, two bike borne miscreants dashed his bike and on the point of pistol, snatched his bike, in which, some ornaments, key of the shop and cash amount of Rs. 20,000/- were kept. It is submitted on behalf of petitioners that petitioners are not named in the FIR. Name of the petitioners has come
Patna High Court CR. MISC. No.4429 of 2021(5) dt.21-06-2021 2/2 during course of investigation. Till date, petitioners have not been put on T.I.P. No incriminating article has been recovered from the possession of the petitioners and petitioners are in custody since 21.03.2020.
However, learned A.P.P. for the State vehemently opposed the bail petition and submitted that looted motorcycle was recovered from the possession of petitioner no. 1 and arms & ammunition were recovered from petitioner no. 2. Considering the aforesaid facts & circumstances and the fact that looted motorcycle was recovered from possession of petitioner no. 1 and arms & ammunition were recovered from petitioner no. 2, I am not inclined to grant them bail.
