The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Nalanda P.S. Case no. 60 of 2015 instituted for the offence under Sections 147, 149, 341, 323, 307, 435, 436, 506 and 302 of the Indian Penal Code.

As per allegation in the FIR, informant in running a primary school at her house and on 28.6.2015 unlawful assembly of 400-500 persons entered into her school and started to assault her. When her husband came there to save her, the accused persons brutally assaulted him as a result of which he died. They also set the school on fire along with two four-wheelers. Petitioner is said to be a member of the mob.

Patna High Court CR. MISC. No.57274 of 2021(2) dt.12-07-2022 2/2 submitted that petitioner is innocent and has committed no offence. General and omnibus allegation has been levelled against him. During investigation when a reporter of G. Purbaiya New agency produced a cassette of recording of the occurrence before the police in which his photograph was identified by his co-villager Guddu Kumar, who is not in good term with him. He has got no criminal antecedent.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Nalanda P.S. Case no. 60 of 2015, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bihar Sharif, Nalanda subject to the conditions as laid down under section 438(2) of the Cr.P.C.
