29.01.2015 Heard learned counsel for the Petitioner and the State.

The Petitioner seeks bail in Chautarwa P.S. Case No. 92 of 1999 (Tr. No. 2502 of 2014) registered under Section 396 of the Indian Penal Code pending before Sri P. Krishna, Judicial Magistrate, 1st Class, Bagaha, West Champaran (or its successor).

Considering that the Petitioner kept absconding for a number of years, I am not inclined to release him from jail custody and, hence, the prayer for bail is rejected. The Trial Court is directed to expedite the trial and for which reason it shall send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, West Champaran, and the Superintendent of Police, West Champaran is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
