====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-03-2022 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in connection with Sonepur P. S. Case No.503 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 01.04.2021, charge-sheet has been submitted in the case and has antecedent of three cases. The learned counsel for the petitioner submits that the informant alleges that his nephew was playing ludo with Ajit Kumar and Sujit Kumar and while playing, a quarrel took place. Ajit Kumar and Sujit Kumar assaulted the nephew of the

Thus, they fled away and again returned with the accused persons and it is alleged that Arvind Rai fired hitting the informant on his chest and accordingly, the informant and his nephew were taken to hospital from where the informant was referred to P.M.C.H. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that no overt act has been alleged against the petitioner. As far as allegation of firing is concerned, that is against Arvind Rai and allegation of assaulting the nephew of the informant is concerned, the said allegation is against Sujit Kumar and Ajit Kumar. General and omnibus allegation has been alleged against all the accused persons regarding assault. The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and no overt act has been alleged against the him, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Ruby Kumari, learned Judicial Magistrate, 1st Class, Saran at Chapra
Patna High Court CR. MISC. No.57653 of 2021(2) dt.03-03-2022 3/3 in connection with Sonepur P. S. Case No.503 of 2020. The application stands allowed.
