2. The petitioner seeks bail in connection with Babubarhi P.S. Case No. 83 of 2025 registered for the offence punishable under Sections 85, 103(1) and 3(5) of the Bharatiya Nyaya Sanhita.
3. The petitioner is the husband of the deceased. There are two small children who are staying with the family of the petitioner. The petitioner is in custody since 16.05.2025.
4. Considering the aforesaid fact, this application is allowed.
5. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
Patna High Court CR. MISC. No.49149 of 2025(2) dt.11-08-2025 2/2 sureties of the like amount each to the satisfaction of the learned JM 1st, Madhubani/ concerned Court in connection with Babubarhi P.S. Case No. 83 of 2025, subject to the condition that the petitioner will co-operate in the trial.
6. Before accepting the bail bonds of the petitioner, the Court below will verify the fact that the children of the petitioner are staying with the family members of the petitioner or not. The bail bonds of the petitioner shall only be accepted if it is found by the Court below that the children of the petitioner are staying with the family members of the petitioner.
