The appellant seeks regular bail in connection with Main P.S.Case No.23 of 2017 registered for offences punishable under Section of the Indian Penal Code and Section 3(2)(v)(a)/3(2)(v)(b)/3(2)(va) of SC/ST (POA) Act. Allegation against the appellant is under Section 302 of the IPC, however, submissions of the learned counsel for the appellant is that the FIR itself shows that the appellant had informed the informant that the deceased has received electrical shock and in spite of that he has been made accused in this case. Heard learned Special P.P. also, who has opposed the prayer for bail.

In view of the facts and circumstances, as stated above,

Patna High Court CR. APP (SJ) No.2435 of 2017 (2) dt.25-08-2017 2/2 let the appellant above named surrender before the court of Special Judge and make prayer for regular bail, which will be considered by the learned Special Judge on the basis of submissions as stated above and considering the fact that the appellant had informed to the informant about electric shock to the deceased, he will pass appropriate order without being prejudiced by the order of this Court if possible on the same day.
