2. Petitioners apprehend their arrest in connection with Chanari P.S. Case No.423 of 2024 instituted under Sections 132 and 223(B) of the B.N.S.
3. As per prosecution case, the petitioners and other accused persons have encroached the government land and when the police officials requested them to remove the encroachment, then the petitioners and other co-accused persons have denied to remove the said encroachment and also misbehaved with the police officials.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.46020 of 2025(2) dt.21-07-2025 2/2 petitioners are innocent and have falsely been implicated in this case. Petitioners have not encroached the government land and they have not made any construction over it. Petitioners are poor persons and they never disobeyed the government's order and never obstructed the police official as alleged. Petitioners have no criminal antecedent and they undertake to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sasaram, Rohtas in connection with Chanari P.S. Case No.423 of 2024, subject to the conditions as laid down in Section 482
(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sunil Dutta Mishra, J) Harish/- U T
