JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 30.6.2014 in a case registered for the offences punishable under Sections 307,333 and 353/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged by the informant being Sub-Inspector of Police that during investigation of Sangrampur P.S. Case No. 11 of 2011, this petitioner resorted to firing twice on the informant and the police force but none received any injury. It is submitted by the learned counsel for the petitioner that admittedly no injury was caused to the informant side and used cartridges have not been seized by the police from the place of occurrence.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-

Patna High Court Cr.Misc. No.4608 of 2015 (2) dt.04-02-2015 2/2 (ten thousand) with two sureties of the like amount each to the satisfaction of learned 10th Additional Sessions Judge, East Champaran at Motihari in connection with S.T. No. 563 of 2014 arising out of Dumariaghat P.S. Case No. 94 of 2012. Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
