JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Tetarhat P.S. Case No. 74 of 2021 dated 23.07.2021 instituted for the offences under Sections 353, 307/34 of the Indian Penal Code and Sections 27 of the Arms Act and Section 37(C) of the Bihar Prohibition and Excise Amendment Act.

Eight persons including the petitioner were found to be displaying drunken behavior on road and when an attempt was made to nab them, the miscreant opened fire. However, nobody appears to have been injured in the occurrence. Nothing incriminating also was recovered from the possession of the petitioner.

The petitioner appears to be a student and he is in

Patna High Court CR. MISC. No.57394 of 2021(2) dt.23-05-2022 2/2 custody since 23.07.2021 and does not criminal antecedent. Taking into account the aforesaid facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge, 2nd cum Special Judge (Excise), Lakhisarai in connection with Tetarhat P.S.
