Petitioner apprehends arrest in a case registered for the offence punishable under Sections 504, 506, 406 and 420 of the IPC and section 138 of Negotiable Instrument Act. As per the prosecution case, the petitioner cheated the informant of Rs. 14,08,000. It is further alleged that the check issued by this petitioner got bounced due to insufficiency of fund.

Learned counsel appearing for the petitioner denies the prosecution case and submits that no case under section 406 and 420 of the IPC is made out against the petitioner, as no money was entrusted to him. Petitioner has got no criminal antecedent.

No.48082 of 2022(2) dt.13-12-2022 2/2 Learned counsel appearing for the State vehemently opposes the prayer for bail and submits that there is specific accusation against the petitioner that he took money from the informant saying that he will give him paddy or return the money and in lieu of that he gave cheque, which was dishonoured.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is refused with direction to the petitioner to surrender and seek regular bail, which would be disposed of on its own merit without being prejudiced by this order.
