====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 30-07-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. Petitioners apprehend their arrest in connection with Karamchat P.S. Case No.51 of 2025 instituted under Sections 126(2), 115(2), 109, 352, 3(5) of the B.N.S., 2023.
3. As per the prosecution case, the informant was assaulted by the petitioners with lathi and iron rod causing injury to him.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. He further submits that both the parties are next door

No.46907 of 2025(2) dt.30-07-2025 2/2 neighbor and a quarrel take place between them, due to which informant fell down from the boundary wall and sustained injury from the accident, but he has filed the false and concocted case against the petitioners. Learned counsel submits that injury to the injured is simple in nature caused by hard and blunt substance. He further submits that petitioners have no criminal antecedent and they undertake to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua, District Kaimur at Bhabua in connection with Karamchat P.S. Case No.51 of 2025, subject to the conditions as laid down in Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
