The petitioner seeks bail in Karza P.S. Case No. 36 of 2021 corresponding to Sessions Trial No. 164 of 2021, registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.
One country made pistol with live cartridge, a mobile phone and a motorcycle have been recovered from possession of this petitioner.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case on the basis of suspicion. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent
Patna High Court CR. MISC. No.57305 of 2021(2) dt.31-01-2022 2/2 and he is in custody since 08.02.2021. Chargesheet has already been submitted. Similarly situated co-accused has already been allowed bail by this Court vide order passed in Cr.Misc.No. 54910/2021.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Vth, Muzaffarpur in connection with Karza P.S. Case No. 36 of 2021.
