The petitioner seeks bail in a case registered under section 379 and 411/34 of the Indian Penal Code. The informant alleged that while he was taking tea some body stole Rs.10900/- from the cabin of the truck. Police apprehended Sanjay Tiwary and from his possession Rs. 10,900/- was recovered.
Learned counsel for the petitioner submits that no recovery was made from the possession of the petitioner. The seizure list does not bear the signature of the petitioner. No body has seen the petitioner committing theft. Petitioner has got no criminal antecedent and he is in jail since 30.09.2014. Considering the fact that nobody has seen the petitioner committing theft and the petitioner has no criminal antecedent, the above named petitioner is directed to be enlarged
Patna High Court Cr.Misc. No.4860 of 2015 (2) dt.04-02-2015 2/2 on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief judicial Magistrate, Muzaffarpur in Minapur P.S. Case No. 402 of 2014.
