2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Excise (Bhabhua) P.S. Case No. 45 of 2025 instituted for the offence under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. The case of the prosecution is that altogether 2.700 liters of illicit liquor was recovered from a bike which was being driven by Sanjay Kumar.

4. Learned counsel for the petitioner has submitted that he has been named in this case because he is the owner of the bike. It has been submitted by the learned counsel that he

Patna High Court CR. MISC. No.45727 of 2025(2) dt.04-08-2025 2/2 has given his bike to the labourer on an urgent call which was being misused by him. The petitioner has not got no knowledge regarding the alleged liquor. The petitioner is a man of clean antecedent.

5. There is no one to represent the State.

6. Having heard learned counsel for the petitioner and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Excise (Bhabhua) P.S. Case No. 45 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise)-II, Kaimur at Bhabhua, subject to the conditions as laid down under Section 482(2) of the BNSS.

7. Accordingly, the present bail application stands allowed.
