This application, for grant of anticipatory bail, arises out of Sonepur P.S. Case No. 190/2017, disclosing offences under Sections 341, 323, 324, 504 and 34 of the Indian Penal Code and sections 25(1)(a) and 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioners has submitted that fire-arm was allegedly seized by the informant and he accordingly contends that in that background, the offence under the provisions of Arms Act is bailable. He has also submitted that the injuries have been found to be simple in nature caused by hard and blunt substance.
Considering the above submission, this application is
Patna High Court Cr.Misc. No.46274 of 2017 (2) dt.07-11-2017 2/2 allowed.
Let the petitioners above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Chapra, in connection with Sonepur P.S. Case No. 190/2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
