Mr. Vinay Krishna Tripathy, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-07-2019 Heard learned counsel for the petitioner and learned counsel for the respondent C.B.S.E. Board.
The grievance of the petitioner in the present application is non-consideration of the case of the petitioner for inclusion of Surname. It is required for the purpose of getting visa.
Learned counsel for the petitioner submits that the petitioner appeared at C.B.S.E. Examination from D.A.V. School. In the records of the School as well as C.B.S.E., the
Patna High Court CWJC No.14424 of 2019(2) dt.18-07-2019 2/3 name of the petitioner was mentioned as Srimi. Now the petitioner is facing problem of non-consideration of her case for grant of visa in the absence of Surname attached to her name Srimi.
Mr. Tripathy, learned counsel appearing for the C.B.S.E. would submit that there is no error on the part of the School or on the part of the C.B.S.E. in maintaining the name of the petitioner as Srimi without Surname, as the Surname was not added at any point of time in the School records or in the records of the C.B.S.E. In absence of any direction by this Court, the C.B.S.E. is not in a position to consider the case of the petitioner for addition of Surname with her name Srimi. Considering the hardship on account of non-inclusion of Surname and the practical problem in getting visa, for ends of justice, the Court is inclined to grant indulgence to the petitioner. The present writ petition is disposed of with a direction to the D.A.V. School to insert the Surname of the petitioner in the form required and thereafter forward the case of the petitioner for corresponding correction of insertion of Surname in the record of the C.B.S.E. Necessary exercise as to addition of Surname in the records of D.A.V. School may be carried out within a period of one month from today, and
Patna High Court CWJC No.14424 of 2019(2) dt.18-07-2019 3/3 thereafter C.B.S.E. is required to carry the necessary correction by adding Surname within a further period of two months' time. With the aforesaid, the present writ petition is disposed of.
