The petitioner seeks bail in Mahua P.S. Case No. 405 of 2014, registered for the offences punishable under Sections 366A and other Sections of the Indian Penal Code.
The informant alleged that his daughter went to purchase medicine but did not return on 29.09.2014. Learned counsel for the petitioner submits that the date of occurrence is 29.09.2014, the Sanha was reported on 01.10.2014 in which the informant suspected that the petitioner kidnapped his daughter with the help of Rinku Devi. It is further submitted that there is no eye witness of the occurrence and except suspicion there is no material.
It appears from the perusal of the records that the
Patna High Court Cr.Misc. No.4458 of 2015 (3) dt.24-03-2015 2/2 informant gave four mobile numbers and alleged that these numbers were used for kidnapping of the daughter of the informant. The petitioner himself admitted that he was using the mobile and have talked with the victim. The victim is a minor and she is hard hearing and she is still traceless. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
