The petitioner apprehends his arrest in connection with Barauli P.S. Case No.55 of 2022 instituted under Sections 420,467,468,471,120(B) of the Indian Penal Code. In view of the CWJC No.15459 of 2014 in which the Hon'ble Court had passed the order, the Vigilance constituted a committee to check the genuineness of the certificate in course whereof it was found that the petitioner is in service on the basis of forged certificate.

Learned counsel for the petitioner at the outset submits that he is no longer in service having already faced the music and has clean antecedent and further he is ready to cooperate with the authorities in investigation. Learned APP on the other hand opposes the prayer for

Taking into account the fact that the petitioner no longer continuing in service, do not have criminal antecedent and ultimately he has to face the music and is ready to cooperate, this Court is inclined to grant him relief. Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Barauli P.S. Case No.55 of 2022 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
