Petitioner apprehends his arrest in Pirpainty P.S. Case No.241 of 2017 registered under Sections 20(B) and 22 of the N.D.P.S. Act.
The gist of the allegation is that the police officials got information about the fact that one person was carrying Ganja and he was coming towards Laxmipur railway station. On search, the police waylaid and apprehended one accused from whose possession 2 Kgs. of Ganja was recovered. The apprehended accused disclosed his name as Md. Jawed. Md. Jawed disclosed that petitioner petitioner Md. Humayun had handed over Ganja to him for carrying the same to the railway station.
Learned counsel for the petitioner submits that save
Patna High Court Cr.Misc. No.75598 of 2018(3) dt.21-01-2019 2/2 and except the statement of Md. Jawed, there is no material against the petitioner but it appears from perusal of the case diary that besides the statement of Md. Jawed, it has come that the petitioner is accused in seven other criminal cases in which two cases are also registered under different sections of the N.D.P.S. Act.
Considering the fact that the petitioner has got criminal antecedents, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
