Petitioner apprehends his arrest in connection with Ekma P.S. Case No.256/2022, registered for the offence punishable u/s 406, 420, 120(B) of the IPC.

As per the prosecution case, on the inducement of the petitioner, the informant deposited money in the account of A Kay Oil Mill Pvt. Ltd. company to the tune of Rs.11 Lakhs but neither the oil was delivered nor his money was returned. 4.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. The informant has deposited the amount in the account of the Company and not in
Patna High Court CR. MISC. No.48368 of 2023(3) dt.12-09-2023 2/2 the account of the petitioner, who was an agent of the said Company. The said Company has not been made an accused by the informant. Earlier the petitioner was agent of the Company but later on he left the Company. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail by submitting that petitioner being the agent of the Company falsely influenced the informant to deposit his money there. 6.
Having regard to the facts and circumstances of the case and considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.
This application is accordingly dismissed.
