The petitioner is languishing in custody since 28.05.2014 in a case registered for the offences punishable under Sections 364, 368, 377, 414, 506 and 323 of the Indian Penal Code.
It is alleged that son of the informant was taken by this petitioner, Babban Kumar Rai and Lalu Basera and subsequently they committed unnatural offence with the son of the informant. Subsequently one motor cycle was recovered from possession of the petitioner which was suspected to be stolen one. It is submitted by learned counsel for the petitioner that the medical examination report does not suggest the commission of unnatural offence. A statement has been made in
Patna High Court Cr.Misc. No.5856 of 2015 (2) dt.12-03-2015 2 / 2 paragraph no. 3 of the petition that the petitioner has no criminal antecedent. Similarly situated coaccused Babban Kumar Rai has been granted bail by this Court vide Cr. Misc. No. 43863 of 2014.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IInd, Jamui, in connection with Sessions Trial No. 253 of 2014, arising out of Chakai P.S. Case No. 49 of 2014. U.K./- (Dinesh Kumar Singh, J) U T
