JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Mansi P.S. Case No. 216 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The learned counsel for the petitioner submits that the petitioner is in custody since 06.08.2021 and charge-sheet has been submitted in this case and allegation is of recovery of 50 litres of country-made liquor and 200 litres of Semi prepared liquor from a field.
The learned counsel for the petitioner submits that the petitioner has no concern with the field and he has been falsely been implicated merely because he was seen around the field.
Patna High Court CR. MISC. No.57192 of 2021(2) dt.07-01-2022 2/2 Learned A.P.P. opposes the bail application.
Considering the fact that petitioner is in custody since 06.08.2021 and charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.2,000/- (Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise) at Khagaria, in connection with Mansi P.S. Case No. 216 of 2020.
The application stands allowed.
