The petitioner seeks bail in a case registered under section 397 of the Indian Penal Code and 25(1-b)/27 of the Arms Act.
The informant alleged that the petitioner along with two other persons made an attempt to commit robbery of his motorcycle but on alarm many persons came there and apprehended the petitioner. Two other persons managed to flee away. From the possession of petitioner one loaded country made pistol is said to have been recovered.
Learned counsel for the petitioner submits that arms was recovered by the public and not by the police and all the allegations are false and concocted. Petitioner was going to
Patna High Court Cr.Misc. No.4911 of 2015 (2) dt.04-02-2015 2/2 Dev Ghar on a motorcycle. The petitioner is in jail since 08.04.2014.
On consideration of facts and nature of allegation made against the petitioner and the fact that the petitioner has already remained in jail for ten months and he has no criminal antecedent, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of 6th Additional District Judge, Banka in S.Tr. No. 567 of 2014 arising out of Chandan P.S. Case no. 34 of 2014. (Prabhat Kumar Jha, J) M.Rahman/- U T
